Your 2015 Congress Has Approved Funding...For Now

Remember the government shutdown of 2014? Well, it appears that those days are primed to be a thing of the past. In an under-reported turn of events, the 2015 congress has reached a bipartisan vote to pass a $1.1 trillion spending budget for the new year, and the POTUS immediately agreed to sign it into effect. As of January 29th, however, our President instead proposed a minimum $74 billion increase in spending caps. More updates are coming. SCOTUS Rules Security Screening Times are not Legally Compensable

In a recent, December 9th ruling, the Supreme Court ruled unanimously that warehouse workers are not entitled to compensation under FLSA for time spent post-shift going through a security screening. The case (Integrity Staffing Solutions v. Busk, No. 13-433) was determined by the Justices ruling that the screening itself was not an "integral" part of the job. Per Justice Clarence Thomas, their reasoning was that Integrity Staffing Solutions hired workers to retrieve products from shelves and package them for shipment to Amazon customers; not to pass through such screenings, and, additionally, that the screenings could have been eliminated without effecting the core job. SHRM article (member login required or contact HRS for more info).  


However... Employees Are Now Legally Allowed Corporate E-mail as a Means to Unionize

As the old saying goes, "You win some; you lose some." The NLRB ruled in a 3-2 vote that employees now have the right to communicate via their corporate e-mail accounts for the purposes of unionizing and collective bargaining. This ruling overturns the original finding from 2007. Board opinion characterized electronic communication as too important to limit for the sake of the employees. Structuring HR: Is Your HR Too Cocky? Study Finds that HR Often Sees Workers as Happier Than They Are

According to a recent study, worldwide trends indicate that HR Managers often rank their employees' levels of engagement and workplace satisfaction, and thus their company's culture, more satisfactorily than the employees themselves. Discrepancies were found in areas of employee satisfaction in compensation packages, leadership ability and inspiration, and, even, the ability to communicate with HR. SHRM article. Think of it this way...if every company believes that they have a top-tier culture, internal brand and/or HR initiative, then, by definition, some of those companies have to be wrong.


Restaurant Study Reveals an Alarming Finding About Customers

Last year, a famous NYC restaurant launched a self-imposed investigation and hired a consulting firm to discover the reason behind their sudden string of bad reviews. Specifically, customer complaints about service and wait times had increased dramatically. Restaurant owners pulled a tape from July 2004, and simultaneously viewed a tape from July 2014 on a similarly busy day. The results, based off of 45 customer transactions from each year, will surprise you. Click here to view the study.

Minimum Wage Raised for Several States

Heated argument continues regarding the economic impact of minimum wage increases. Review this government reference for an index of which states have already enacted minimum wage increases, and which have plans to during either 2015 or 2016.


Payroll/Tax Limits Increased

Effective for 2015, the U.S. Government enacted the following increases: FSA Contribution Limit raised $50 to $2,550; Single 401(k) Contribution Limit raised to $18,000, Employer plus Employee raised to $53,000; Salary Subject to FICA increased to $118,500 from $117,000; Standard Mileage Reimbursement Rate raised to 57.5 cents/mile.
