Laws Protect Convicted Applicants, Social Media Accounts and Marijuana Users

New protections for job applicants convicted of crimes, for employees who use medical marijuana and for workers' private social media accounts are among the state laws that take effect in 2014.  Article. In addition to newly passed state laws, please remain cognizant of increased stakes in federal compliance, especially as related to the Fair Credit Reporting Act (FCRA) in governance to employee investigations. As the failure to investigate with due diligence can result in employer negligence, job-related checks must be conducted within proper boundaries and according to changing laws.  

Smoking Out the Truth on E-Cigarettes in the Workplace

As of January 2014, thirty U.S. states have enacted restrictions against E-Cigarettes in smoke-free facilities. These include twelve statewide laws plus local laws affecting eighteen other states. Employers have a right to prohibit use within their private facilities. However, as precedent law continues to shape, be wary of complaints in protection of addiction, use of lawful product and genetic predisposition at a minimum. In consideration of changing laws, employers may wish to consider a designated smoking area, likely outdoors. Wielding accusations of toxins, second-hand harm, allergens and unpleasant odor, E-cig opponents are likely residing in the are E-Cig fans.  Watch for this issue to heat up... where there's fire, there's smoke.

NLRB Poster Requirement Dead

The National Labor Relations Board (NLRB) rule requiring virtually all employers to post a notice advising employees of their rights under the National Labor Relations Act (Poster Rule) is dead. More info.

Common Employer Mistakes in FMLA Handling

Employers continue to miss opportunities for cost containment, convenience and risk management. Common errors in FMLA handling include late qualification, retroactive designation, retaliation and discriminatory practice. Article. A well-written FMLA policy shifts burden to employees for timely notice and certification, eliminating need to "hunt down" employee documentation and avoiding HIPAA privacy risks. Sequencing and substitution of paid time off requires advance planning, documentation and notice to staff. Properly crafted policies can reduce administrative burden by more than 75%. BLS Predicts Slowdown in Job Creation Except for HR & Health Care Openings 

Slower population growth, decreased participation in the labor force and lower economic demand will all contribute to a reduced pace of job creation in the next 10 years, according to the latest projections by the U.S. Bureau of Labor Statistics (BLS). Article.
